Domestic Assault

Domestic assault in Ontario is treated more severely than assault which takes place outside the domain of the domestic. This is mainly because domestic assault cases are increasingly common in Canada, domestic abuse directly and negatively impacts children, and there is a risk of increasingly violent behavior if the domestic abuse is not interceded and dealt with.

Domestic assault occurs within an intimate relationship, including between and among boyfriends and girlfriends, common law, spouses, and family members. Domestic assault is not always physical, but verbal, in the form of threats, coercion, and economic abuse.

Due to the Crown’s zero tolerance policy, those accused will be under bail restrictions that sternly limit and inhibit communication with their loved ones. If the accused person is found guilty of the charges, the consequences range from a peace bond to a significant amount of jail time.
