Can You Still Be Detained with an NCR Verdict for Murder?

In December 2024, Mr. Li Kai Li was found not criminally responsible (NCR) for charges of attempted murder and assault due to a diagnosed mental disorder, specifically schizophrenia. This determination underscores the legal system's recognition of the profound impact mental health can have on an individual's actions and culpability.​

Case Overview

The incident occurred in June 2023 within the Li family residence in Markham, Ontario. Mr. Li, experiencing untreated mental health issues and regular cannabis use, attacked his mother and two adult sisters, resulting in severe injuries. He believed, due to his delusions, that his family members had "chips implanted in their brains" and posed a threat to him. Following his arrest, Mr. Li was diagnosed with schizophrenia and admitted to the Ontario Shores Centre for Mental Health Sciences for assessment and treatment.​

Legal Proceedings and Findings

On December 11th, 2024, based on psychiatric evaluations, the court found Mr. Li NCR. Subsequently, the Ontario Review Board (ORB) convened in February 2025 to determine the appropriate disposition. The ORB concluded that Mr. Li represented a significant threat to public safety but acknowledged that his risk could be managed with a detention order at Ontario Shores, allowing for the possibility of community living under strict conditions in the future.​

When Do NCR Verdicts Still Result in Detainment?

When a defendant is found Not Criminally Responsible (NCR) due to a mental disorder, it does not mean they walk free or avoid consequences. Instead, the legal system shifts the focus from punishment to treatment. In Mr. Li's case, the court determined he posed a significant risk to public safety and ordered that he be detained, not in a prison, but in a secure psychiatric facility.
